Terms of Service

These Terms of Service ("Terms") govern your access to and use of the hosting services provided by Alpha Six Hosting ("AlphaSix", "we", "us"). By opening an account or using our services, you agree to these Terms.

1. The Service

AlphaSix provides LAMP-stack web hosting optimized for platforms including Concrete CMS, WordPress, and Kirby, along with related services described in your account. Specific resources, features, and limits are set by the plan you select at signup.

Enterprise or Custom plans will be configured on a dedicated web server to meet the specific requirements identified and are subject to a minimum one-year contract.

2. Your Account

You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use. You must be able to form a binding contract to open an account.

3. Acceptable Use

You agree not to use the service to host, transmit, or facilitate:

• Unlawful, infringing, or fraudulent content or activity of any kind;
• Unsolicited bulk email (spam), phishing, or malware distribution;
• Content that violates the rights of others, including intellectual property or privacy rights;
• Activity that degrades, disrupts, or places unreasonable load on shared infrastructure or other customers.

We may investigate suspected violations and take action, including removing content or suspending service, to protect our platform and customers. Accounts that violate our terms will be terminated with no refund.

4. Billing and Renewals

Fees, billing cycles, and payment terms are presented at checkout and managed through our client portal at a6.alpha-6.com. Unless cancelled beforehand, plans renew automatically for successive terms at the then-current rate. You are responsible for keeping a valid payment method on file.

5. Cancellation and Refunds

You may cancel at any time through the client portal. You may cancel your account at any time within the first 36 days of registration with a full refund. After that period, no refunds are availble.

Any products or services that were suspended, canceled, or terminated due to the abusive usage of the products, services, or any other violation of the Terms and Conditions are not eligible for a refund.

Domain name purchases are not refundable under any circumstances.

Refunds are only available via the original payment method.

6. Service Availability

We use commercially reasonable efforts to keep the service available and to maintain the infrastructure it runs on. Scheduled maintenance, emergency maintenance, and factors outside our reasonable control may cause interruptions. Any specific service-level commitments, if offered, will be stated separately in writing.

7. Backups and Your Data

You are responsible for maintaining your own current backups of your content and data. While we may keep backups for operational purposes, you should not rely on them as your sole copy. You retain ownership of the content you host with us.

8. Suspension and Termination

We may suspend or terminate service for non-payment, violation of these Terms, or to protect the platform, our customers, or third parties. Where practical, we will provide notice. You may terminate at any time as described above.

9. Third-Party Services and Software

The service may let you install or connect third-party software and services (for example, CMS platforms, plugins, or payment processors). Those are governed by their own terms, and we are not responsible for them.

10. Disclaimers

Except as expressly stated, the service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, AlphaSix will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the service will not exceed the amount you paid us for the service in the [three] months preceding the claim.

12. Indemnification

You agree to indemnify and hold AlphaSix harmless from claims arising out of your content, your use of the service, or your violation of these Terms or applicable law.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a revised date. Your continued use of the service after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of New York State, without regard to conflict-of-law principles. Disputes will be resolved in the courts located in Onondaga County, New York.

AlphaSix hosting is provided as-is and as-available. We don't offer warranties beyond what's stated in these Terms, and our liability is capped as described in Sections 10 and 11. It's standard for hosting — we just didn't want to bury it.
